55+ community rules in Florida, explained
The 80/20 rule, younger spouses, adult children, pets, rentals and guests. What federal law actually requires, and where each community sets its own line.
Most of what people believe about 55+ rules is roughly half right, which is the most expensive kind of wrong.
The 80/20 rule, properly stated
Age-restricted housing is legal in the United States because of a specific carve-out from the Fair Housing Act, created by the Housing for Older Persons Act. To qualify as housing for older persons, a community must satisfy three things:
- At least 80 percent of occupied units have at least one resident aged 55 or older
- The community publishes and adheres to policies demonstrating intent to operate as housing for older persons
- The community verifies ages through reliable surveys and documentation
Two things follow from that, and both surprise people.
Only one occupant needs to be 55. If you are 57 and your spouse is 51, you generally qualify. The rule is about the household, not every individual in it.
Up to 20 percent of homes may have no resident over 55 at all. That is the legal ceiling, not a target. Many communities operate far closer to 100 percent by their own choice, and a community is entitled to set a stricter rule than the law requires. Never assume the 20 percent is available to you.
So can you buy if you are under 55?
Sometimes. It depends on the individual community's governing documents, on whether they are currently near their 80 percent threshold, and on whether they have chosen a stricter internal policy. Some will approve a younger buyer, many will not, and the answer can change from year to year depending on the community's current mix.

Adult children and younger family members
Rules on permanent occupancy by anyone under a minimum age, often 18 or 19, are usually strict and are usually enforced. Extended visits by grandchildren are normally fine, and there is often a stated limit on consecutive days or total days per year. If a child or grandchild may need to live with you, that has to be checked in writing before you buy.
Pets
Almost every community allows pets, and almost every one limits them differently. Common variations: one dog versus two, a weight cap that might be 15, 25 or 35 pounds, occasional breed restrictions, leash and designated-area rules, and separate rules for guests' pets.

Renting your home
Most 55+ communities in Palm Beach County allow leasing with restrictions, and the restrictions are meaningful if rental income is part of your plan:
- A minimum ownership period before you may lease, often one or two years
- A minimum lease term, frequently three, six or twelve months
- A cap on the number of leases per year, sometimes one
- Board approval of the tenant, including an application fee and background check
- The tenant must independently satisfy the age requirement
If you are buying partly as an investment, this is the first thing to check, not the last.
Guests and seasonal occupancy
Most communities permit guests freely for reasonable periods and require registration beyond a certain length of stay. Snowbird patterns are entirely normal here and are usually well accommodated. What is generally not permitted is anything that functions as a short-term rental.
Golf carts, vehicles and parking
Frequently overlooked and frequently annoying. Many communities restrict overnight street parking, commercial vehicles, pickup trucks with visible equipment, recreational vehicles and boats. If you own a truck or a boat, check before you buy.
The rule about rules
Federal law sets the floor. Every association is free to be stricter, and many are. The only document that governs your home is that community's own declaration, bylaws and rules, as currently amended. I read them for every client before we go under contract.

Can you live in a 55+ community if you are under 55?
Sometimes. Federal law requires only that 80 percent of occupied units have at least one resident aged 55 or older, which leaves room for younger households. But each community sets its own policy inside that framework and many choose to be stricter. Ask before you tour, not after you offer.
Does both spouses have to be 55 in a Florida 55+ community?
Generally no. Most communities require only one occupant to meet the age requirement, so a 57 and 51 couple usually qualifies. Confirm the specific rule, because some communities set a minimum age for the second occupant as well.
Can my adult child live with me in a 55+ community?
Usually not on a permanent basis. Most communities set a minimum age for permanent occupants, often 18 or 19, and enforce it. Extended visits are normally allowed within a stated limit. Get the answer in writing before you buy.
